Board Policy 94-1

Article VIII, Section 1 and 2 of the C & R's concern architectural review and control of improvements to houses or lots in Ballena Bay. Article Xl outlines use restrictions for residential lots. Within that framework, the following procedure describes the process of obtaining approval for improvements. Improvements requiring approval include any which are visible from the street or waterside. It is possible that any work which is undertaken without 'the proper approval might later need to be removed or corrected at the homeowner's expense.
The homeowner shall submit the proposed improvement to the BBTA's Community Manager, using the Architectural Review Request Form, complete with drawings showing work to be. completed, materials to be used and a short written description of the work to be completed and the construction schedule.
If the Architectural Review Committee recommends approving the project, they will consult with any homeowners who may, in the opinion of the Committee be affected by the proposed Improvement. The Architectural Review Committee will review the proposed improvement and advise the Board. If the Board approves, they will inform the Manager who will formally advise the homeowner of the decision,
Homeowners with objections to the proposed work must register these objections in writing to the Committee. Any homeowner objection which has merit in the opinion of the Committee may constitute grounds for denial of the application. However, any such objection must have a .substantial basis. In the event that a homeowner wishes to appeal a decision of the Committee to the Board, the Board will be the final arbiter of the merit of the appeal.
If approved, the homeowner must begin construction within six months of approval and complete the improvement within one year of approval.
