Rules Governing Changes in Arrangements of Docks

The design of the Association’s docking systems provides for one exclusive docking slip in the common area for each residence, arranged in groups of four serving four homes. The theoretical position of these slips is dimensioned as a docking easement in the title documents of each home.

None of the docks was built exactly to the dimensions shown on the title; many docks have been modified at the request of owners, with the approval of the Association. The rules below, adopted by the Association in 1976 and reissued here with minor clarifications, will continue to provide the basis for consideration of applications for dock modifications

A. The petitioning homeowner shall submit a written request to the Board including dimensioned plans showing the dock arrangement before and after the proposed modification. The proposed arrangement must meet the conditions outlined below.

B . To provide space for backing and turning, where docks face other docks across the channel he gap’ between the longest boats 1hat can legally be moored in the docks shall not be reduced to less than one and one half times the length of such longest boat. A boat Is permitted to extend beyond the end of its mooring slip fingers 10% of its overall length; the length of a mooring slip finger does not include piling or pile ring. Thus a 33-foot boat may be moored In a 30·foot slip, a 44·foot boat in a 40-foot slip. In considering a mooring slip extension It shall be assumed that the slips on the opposite side of the channel retain a right to a future extension to an equal length. Example: In extending an existing 30-foot slip to 40 feet. the gap remaining to a future 40·toot slip across the channel, measured between the slip ends shall be at least 74 feet: 44 x 1.5 times 66 feet plus the 4 foot overhang of the two opposite boats).

C. Where reorientation of an end dock finger is requested the resultant configuration must not restrict access to the adjacent group of docks and must leave space adequate to modify the end finoer of the adjacent .group of docks in a similar manner.

D. A proposed change shall not in other ways adversely affect maneuvering space for boats In the channel. Neighbors on the same dock and other potentially affected residents will be consulted, and their reasonable objections will be taken into consideration by the Board in reaching Its decision, which shall be final.

E. Dock modifications will be performed by the Association, scheduled where feasible to coincide with other planned dock work; cost will be charged to the homeowner. The docks remain the common area property of the Association, and except where specifically provided to the contrary at the time of approval. will in the future be maintained by the Association.

F. No arbitrary time limit applies to the approval process. Applications will be processed with all reasonable speed consistent with thorough investigation of effects of proposed changes and full consultation with all those who may be affected.
