Abandoned Property in Exclusive Use Common Area

Abandoned property in exclusive use common area (for example, a unit’s assigned boat slip) is the responsibility of the homeowner.

There shall be no obligation on the part of the Association to remove or dispose of property in exclusive use common area.

In the event property is abandoned by a previous owner upon sale of a residence, the property will then become the responsibility of the new homeowner.

A copy of this policy shall be made available to all listing agents for homes for sale for purposes of fully disclosing the responsibilities of the buyer regarding abandoned property.

It is the intent of this policy to clarify that there is no responsibility on the part of the BBTA for property within a home or within exclusive use common area assigned to a given home. This in no way modifies or rescinds the Association’s rights and abilities regarding other common area such as (but not limited to) docks, parking areas, landscaped areas and those portions of the buildings maintained by the Association.
